Blanket Ban Out – Pet in Apartments

Pet Insurance Australia is thrilled to hear of the NSW Court of Appeal ruling that is allowing pets into apartment complexes throughout the State and abolishing the blanket no-pet ban.
“This is just wonderful news, and a huge relief for many pet, and apartment, owners in NSW,” Nadia Crighton from Pet Insurance Australia says. “This new ruling has officially overturned the right to pass any bylaws to prohibit animals from living in apartment buildings.”
For many years countless pet owners have been left in the dark when it comes to the rules and regulations surrounding the bylaws. Many of these laws were preventing their beloved companion animals from residing in apartment buildings across NSW.
“The ruling has now put a stop on blanket bans on pets living in apartment buildings for the whole state of NSW,” Crighton says. “This is massive for all pet owners living in apartment buildings. The thought that a loving pet owner would have to consider rehoming their pet due to these bans is inconceivable.”
With the increase in adoptions and purchases of pets during 2020, due to Covid, the need to allow pets into apartment buildings has only increased. This new ruling will give many NSW residents a massive feeling of relief.
“There is a risk, however, that this could once again be appealed at the High Court of Australia,” Crighton says. “With pets being such a vital part of many homes, and offering such comfort and wellbeing, we hope that this blanket ban overturning is here to stay.”
According to The Court of Appeal, these no-pet blanket bans infringed the limitation of the bylaws being harsh unconscionable, or oppressive. This new ruling will affect many apartment buildings across Sydney and the whole of NSW. Many pet lovers are now hoping these no-pet blanket ban bylaws will be abolished Australia wide.

“It’s only a small handful of bad experiences that can put a damper on many people’s thoughts when it comes to pets living in apartment buildings and rental properties,” Crighton says. “Some basic tips can ensure you keep everyone happy, and respectful to those who simply do not like pets.”
Tips for a Good Apartment Pet
- Keep your pet on a close leash at all times (preferably a harness or a snap collar to prevent elevator injuries).
- Tackle behavioural issues head-on – barking, jumping, whining.
- Ensure your dog is well-trained and well-behaved.
- Always pick-up after your pet has toileted.
- For cats – keep litter trays clean.
- For cats – scratching posts are a must to prevent any damage due to scratching.
- Speak to your neighbours if they have any problems that you are not aware of.
